Loopie Terms of Service

§ 1
General Provisions

  1. These Terms of Service determine the use of services offered by Loopie Piotr Pałyga and apply to all relations between the Service Provider and the User.
  2. The Service Provider is Loopie Piotr Pałyga, NIP (Taxpayer Identification Number): 9591804627, REGON (National Economy Register Reference): 260441091.
  3. The subject of the service concerns running an advertising campaign on the Instagram platform, which can be used by users who want to increase the popularity and reach of their social media.
  4. The User accepts the Terms of Sale of the service by clicking on the checkbox.


§ 2
Definitions

  1. User: a natural person or legal entity with an account on the Instagram platform that uses the Loopie service, under the conditions indicated in these Terms of Service.
  2. Service provider: Loopie Piotr Pałyga, NIP (Taxpayer Identification Number): 9591804627, REGON (National Economy Register Reference): 260441091
  3. Service: an advertising campaign implemented by the Service Provider on the Instagram platform, which aims to gain more followers for the User’s Instagram account


§ 3
Conditions

  1. The conclusion of the Sales Agreement between the User and the Service Provider takes place after the User submits an Order on the website loopie.pl.
  2. The price of the Service shown on the Website is given in Polish zloty (PLN) and includes taxes. The User is informed on the Website about the total price including taxes of the Product being the subject of the Order when placing the Order, also when the User expresses willingness to be bound by the Sales Agreement.
  3. After placing the Order, the Service Provider shall immediately confirm receipt of the Order, and at the same time accepts the Order for execution. The Service Provider confirms receipt of the Order, and its acceptance for execution takes place by sending a relevant e-mail to the User’s e-mail address provided during the Order placement process. The message sent contains the Service Provider’s statements about receipt of the Order and its acceptance for execution, as well as confirmation of concluding the Sales Agreement. Upon receipt by the User of the above e-mail, the Sales Agreement is concluded between the User and the Service Provider.
  4. The Customer receives confirmation of concluding the agreement. The confirmation is sent to the e-mail address indicated by the User when placing the order.
  5. The Service Provider shall provide services to the Customer to the extent and under the conditions specified in these Terms of Service or an individual offer, if one has been submitted and accepted by the Customer.
  6. The Customer agrees to comply with these Terms of Service.
  7. The Customer is obliged to use the Service Provider’s website and services in a lawful manner and respect the personal rights, copyright, and intellectual property of the Service Provider and third parties.
  8. The Customer undertakes to provide true data.


§ 4
Rights and obligations of the Service Provider

  1. The Service Provider undertakes to strive to ensure that access to the Website, through which the User places an order, is continuous and secure.
  2. For acts and omissions, in particular resulting in violation of the Rules of Procedure the Instagram portal the user bears full responsibility.
  3. The Service Provider shall not be liable for any damages incurred by the User as a result of a malfunction of the devices used by the User to perform transactions.
  4. The Service Provider is not responsible for the temporary or permanent blocking or restriction of the User’s Instagram account.
  5. The Service Provider shall not be liable for the functioning of interfaces and telecommunication links that are not owned or operated by the Service Provider, in particular, interfaces used by the User to perform transactions.
  6. The Service Provider guarantees that on the User’s Instagram account, on which the Service is properly activated, there will be an increment of followers each month from 300 to 1200. If this amount is not reached, the Service Provider undertakes to run the Service free of charge until the guaranteed number of followers is reached.
  7. The Service Provider will activate the Loopie service on the User’s account within 3 business days from the date of purchase. To launch on the date specified, the subscription fee must be paid and correct data provided in the Complete Me section of the Customer Panel (including details such as the Instagram account’s username and password and access codes in the case of two-step account verification).
  8. The Service Provider will only launch the Loopie service for the Instagram account provided during the ordering process. It is not possible for the User to change the account later.


§ 5
Rights and obligations of the Service User

  1. The User declares that they have read the terms and conditions of the Instagram platform.
  2. The User, by means of a checkbox marked during the ordering process, declares that they agree they do not have the right to withdraw from the agreement, following art. 38 p. 1 of the Consumer Rights Act of 30 May 2014.
  3. To activate the service on the User’s Instagram account, the User must have a minimum of 10 entries/posts and a profile picture on the account on the Instagram social networking service.
  4. The User declares that the followers of their account prior to using the service were acquired organically. If followers were acquired by other means, the Loopie Guarantee of acquiring between 300 and 1,200 new fans per month may not apply.
  5. The User is obliged, after placing an order and making/completing the payment correctly, to complete the Complete Me section in the Customer Panel at loopie.pl


§ 6
Payments

We distinguish the following packages in the Loopie.pl online store:

Starter package 1 mth – £ 51 for the first month, only for new users. Applies to auto-renewing subscriptions only. Subsequent months of subscription are priced at £ 55.

  1. The fee for using the service is charged in advance, monthly, quarterly, half-yearly, or yearly – depending on the package selected.
  2. Automatic (card) payment is made using the Stripe app. The Operator shall not reimburse the User the fee for the unused part of the monthly subscription.
  3. It is possible to pay for the service by online transfer through the Stripe application (Przelewy24) only if the user does not opt for automatic payment renewal. The Operator shall not reimburse the User the fee for the unused part of the monthly subscription.
  4. The Service Provider may from time to time make changes to the service fees and changes to subscription plan specifications, but any such price or subscription plan changes will be effective no earlier than 30 days after the e-mail notice is sent to the user.


§ 7
Terms of terminating the agreement

  1. The subscription may be canceled by logging into the Customer Panel at www.loopie.pl under My Subscriptions, clicking Manage, and then Cancel Subscription.
  2. The subscription may be canceled at any time, with access to the service continuing until the end of the billing period.
  3. If the subscription is canceled during the subscription period, the fees for the unused portion of the subscription will not be refunded.


§ 8
Personal data processing and protection

  1. The Data Controller is Loopie Piotr Pałyga, NIP (Taxpayer Identification Number): 9591804627, REGON (National Economy Register Reference): 260441091.
  2. The personal data provided by the User are used to the extent necessary for the proper implementation of the order and the Service.
  3. To execute the order and the Service, the User provides the following data:
    •  Mandatory:
      • e-mail address,
      • surname,
      • name,
      • cell phone number,
      • username on Instagram and password,
      • names of 10 accounts on Instagram
    • Voluntary:
      • address of residence
      • company details
  1. The User provides their personal data voluntarily, however, if they fail to provide the mandatory data listed in section 3(a), the Service Provider may refuse to perform the offered Services.
  2. The User has the right to:
    • correct,
    • delete,
    • limit data processing,
    • object to data processing,
    • transfer data,
    • lodge a complaint with a supervisory authority.
  1. Limiting the processing by the User to the extent that does not allow the order to be processed, may result in the Service Provider’s refusal to perform the Service.
  2. The User agrees that the owner of the website may use the data provided by them when placing an order for marketing purposes and market analysis, including the transmission of commercial information by means of electronic communication; this consent is given when placing an order by marking the relevant checkbox.
  3. The users’ personal data will not be passed on to third parties for marketing purposes.


§ 9
Complaints

  1. Complaints related to the provision of electronic services by the Service Provider can be submitted in writing to the address of the Service Provider or in electronic form via e-mail to the address kontakt@loopie.pl It is recommended to provide the following in the description of the complaint: information and circumstances relating to the subject of the complaint, in particular, the type and date of occurrence of irregularities; the Customer’s request and contact details of the complainant.
  2. The Service Provider shall address the complaint immediately, not later than 14 calendar days from the date of its submission. If the complaint cannot be processed within this time, the Service Provider shall notify the complainant within this period of time of the reasons for the delay, as well as the expected necessary time for processing the complaint.


§ 10
Final provisions

  1. The Service Provider is entitled to make unilateral changes or additions to these Terms of Service at any time; the User will be informed of the changes by e-mail. If the User does not agree to the changes, the Service will be terminated. If the User does not respond to a notice of changes to the Terms of Service, it will be accepted by default 30 days after the notice is first displayed.
  2. The terms of cooperation are determined solely by the Terms of Service. Any informational or advertising materials regarding the Service are for informational purposes only and are not legally binding.
  3. Disputes under this agreement shall be settled by the court having jurisdiction over the city of Kielce
